Terms of service
These terms set out how we provide the MODELMATIC platform, what you can expect from us and what we expect from you.
Version of 2026-10-03
This document is awaiting company registration details (tax ID, registry number, address). Until then, treat it as a draft. The Polish version prevails in case of any discrepancy.
§1. Who provides the service
The service is provided by MODELMATIC Sebastian Kuźmicz, a sole proprietorship registered in the Polish CEIDG register, address: ———, tax ID (NIP) ———, registry number (REGON) ———, e-mail: support@modelmatic.pl.
§2. Definitions
- Platform — the service at modelmatic.pl together with the ModelFactory and ModelMES applications.
- ModelFactory — a discrete-event simulator, that is, a digital twin of a production line.
- ModelMES — a system supporting real-time production management.
- Account — the set of resources linked to your e-mail address.
- Instance — a separate, isolated environment with its own database, assigned to one customer.
- Plan — the set of features available under the chosen variant of the service.
§3. What exactly we provide
The platform is delivered as a service accessed through a browser. We do not sell software licences and do not hand over source code — we provide a working service for the term of the contract.
The feature set depends on the plan. Current plans, their prices and the length of the trial period are given by the pricing section on the home page, which is the binding source.
§4. What you need in order to use the platform
A device with an internet connection and a current browser with JavaScript and cookies enabled. Nothing needs to be installed. Some views — the production line editor in particular — are designed for a larger screen and will be less convenient on a phone.
§5. Account
Creating an account requires an e-mail address and your name, followed by confirming the address through a link we send. Accounts left unconfirmed for 7 days are deleted.
One account belongs to one person. Do not share your credentials — add other people as separate users instead. We recommend enabling two-factor authentication.
If you suspect someone has learned your password, change it immediately and let us know.
§6. Payments
Payments are handled by Stripe. We have no access to your card details.
The subscription renews automatically for the next billing period until you turn it off. You can cancel at any time in the panel — the service then runs until the end of the paid period and we charge nothing further.
Prices in the pricing section are net; VAT at the applicable rate is added on the invoice. Invoices are issued to the details given in your account settings.
§7. Withdrawal from the contract
If you are a consumer, or a natural person entering into a contract directly connected with your business but not of a professional character for you, you may withdraw within 14 days without giving a reason. An e-mail to support@modelmatic.pl is enough.
If you ask us to start the service before that period ends and you use it, you pay for the period actually used — we refund the rest.
§8. Your data on the platform
The data you enter into the applications remains yours. We process it solely in order to provide the service. We do not use it for our own purposes, do not share it with anyone and do not combine it with other customers' data.
The rules for processing personal data are set out in the Privacy policy, which forms an integral part of this contract.
After the contract ends we delete the data from your instance. If you want to retrieve it beforehand, tell us before termination and we will prepare an export.
§9. Availability
We aim for uninterrupted operation but do not guarantee it. Planned maintenance is announced in advance and carried out outside peak hours, as far as the nature of the work allows.
We may temporarily restrict access where platform security or a legal obligation requires it.
§10. What is not allowed
- circumventing security measures or accessing other customers' data,
- loading the platform in a way that threatens its stability, including large-scale automated traffic,
- entering unlawful content or other people's data without a legal basis,
- reselling access to the account to third parties without our consent.
§11. Complaints
Send complaints to support@modelmatic.pl, describing the problem and, where possible, when it occurred. We reply within 14 days.
Consumers may also use out-of-court dispute resolution, including the EU ODR platform at ec.europa.eu/consumers/odr.
§12. Liability
We are liable for non-performance or improper performance of the contract under the general rules of the Polish Civil Code.
Simulation results are a forecast based on the data and assumptions you provide. They do not replace engineering or business judgement, and we are not liable for the consequences of decisions taken solely on their basis.
Towards customers who are not consumers, our liability is limited to the fees paid in the twelve months preceding the event and does not cover lost profits.
§13. Termination
You may terminate at any time by deleting your account or cancelling the subscription.
We may terminate with 30 days' notice, or with immediate effect in the event of a gross breach of these terms, after first calling on you to stop the breach.
§14. Changes to these terms
We will notify you of changes by e-mail at least 14 days in advance. If you do not accept the new wording, you may terminate the contract before the changes take effect.
§15. Final provisions
Matters not covered by these terms are governed by Polish law. Disputes with customers who are not consumers are settled by the court having jurisdiction over the provider's registered office.
